All work included in the contract must be fully completed on or before October 31st, 2024 All bids must be in a sealed envelope plainly marked “Cell 21 Waste Excavation and Construction Project SW 23-04”, and attached to the outside of the bid envelope must be A SEPARATE ENVELOPE LISTING ALL ADDENDA TO THE PLANS AND SPECIFICATIONS AND AN ACKNOWLEDGEMENT BY THE BIDDER OF RECEIPT OF SUCH ADDENDA (Either on the outside of the Bid Envelope or inside the Bid Bond Envelope), AND THE CONTRACTOR’S LICENSE. THE SEPARATE ENVELOPE SHALL ALSO CONTAIN signed MBE/WBE Solicitation Sheets, and A BIDDER’S BOND IN THE AMOUNT OF 5% OF THE FULL AMOUNT OF THE BID executed by the bidder as principal and by a surety authorized to do business in the State of North Dakota, conditioned that if the principal’s bid is accepted and the Contract awarded to the principal, the principal, within 10 days after notice of award, shall execute a Contract in accordance with the terms of the bid and a contractor’s bond as required by law and the regulations and determinations of the City Commission. Countersignature of a bid bond is not required under this section. All Bidders, except a bidder on a municipal, rural, and industrial water supply project authorized for funding under Public Law No. 99-294 [100 Stat. 426; 43 U.S.C. 390a], must be licensed for the full amount of the bid, as required by N.D. Cent. Code Section 43-07-07. A copy of the Contractor’s License, issued by the Secretary of State, must be enclosed in the bid bond envelope as required under N. D. Cent. Code Section 43-07-12. A Contractor must be the holder of a license at least ten (10) days prior to the date set for receiving bids to be a qualified bidder. No bid may be read or considered if it does not fully comply with these requirements and any deficient bid submitted shall be returned unopened to the Bidder. The City Commission reserves the right to reject any and all bids and rebid the project until a satisfactory bid is received. Bidders on this work will be required to comply with Title 40 CFR Part 33– Participation by Disadvantaged Business Enterprises in the United States Environmental Protection Agency Programs. The requirements for bidders and contractors under this regulation concern utilization of Minority Business Enterprises (MBE), Women’s Business Enterprises (WBE), and Small Business Enterprises (SBE) and are explained in the specifications. The goal for MBE is 2% of the total dollar value of the project. The goal for WBE is 3% of the total dollar value of the project. To demonstrate a good faith effort to comply, bidders must include the MBE/WBE subcontractor solicitation form in the bid package.
